Fundamental dishonesty rules must never be used against vulnerable, injured people

The Association of Personal Injury Lawyers believes abuse of the fundamental dishonesty rules by some defendants in personal injury cases is likely to escalate if the issue is not addressed by regulators.

"Fundamental dishonesty accusations are being used as a tactic to exhaust - financially and psychologically - vulnerable, injured people. In these situations, some defendant representatives are prioritising their duty to the client at the expense of their duty to uphold public trust," APIL’s president said in a comment piece for The Times.
APIL has highlighted the harm that unfounded allegations can cause to honest claimants, especially given the power imbalance between claimants and insurers with almost unlimited resources.
It follows APIL’s submission to a Legal Services Board consultation on its draft policy statement on ethical duties for legal professionals.
