Clinical negligence claims taking too long to settle

However, new research by the Association of Personal Injury Lawyers (APIL) indicates that clinical negligence claims valued up to £25,000 are taking longer than ever to settle.

In recent years there has been a huge increase in the time it takes NHS Resolution (NHSR) to settle these claims. In 2022/23, clinical negligence claims valued at £1,501 - £25,000 were settled in an average of seventeen months, compared to just eleven months in 2010/11. As a result, these claims are now taking an extra six months to settle when compared to twelve years ago.

We urge NHS Resolution to put the injured person first and to settle clinical negligence claims as swiftly as possible.
